General Terms and Conditions of Online Sale

These terms and conditions of sale are concluded on the one hand by the company New Discount, brand of the Arlis Group, with a capital of 50,000 euros whose registered office is at 7 rue de la redoute, 92390 Villeneuve la Garenne, registered with the trade and companies register of Nanterre under the number 82758591000017 hereinafter referred to as New Discount and on the other hand, by any natural or legal person wishing to make a purchase via the New Discount website hereinafter referred to as "the buyer".

Purpose

These terms and conditions of sale aim to define the contractual relations between New Discount and the buyer and the conditions applicable to any purchase made through the New Discount merchant site, whether the buyer is a professional or a consumer.

The purchase of a good or service through this site implies the unreserved acceptance by the buyer of these terms and conditions of sale.

These terms and conditions of sale shall prevail over any other general or special conditions not expressly agreed by New Discount.

New Discount reserves the right to modify its terms of sale at any time. In this case, the applicable conditions shall be those in force on the date of the order by the buyer.

Characteristics of the goods and services offered

The products and services offered are those listed in the catalog published on the New Discount website.

These products and services are offered subject to available stocks.

Each product is accompanied by a description established by the supplier; for some of them, marked DF, the buyer may have access to the supplier's documentation.

All our licensed products have undergone various authenticity checks. The resale of these products is therefore free.

The photographs in the catalog are as faithful as possible but cannot ensure a perfect similarity with the product offered, particularly with regard to colors.

Prices

The prices listed in the catalog are prices exclusive of VAT in euros; any change in tax or rate may be passed on to the price of products or services.

New Discount reserves the right to modify its prices at any time, it being understood that the price listed in the catalog on the day of the order shall be the only one applicable to the buyer.

The prices indicated do not include order processing, transport and delivery costs provided that these take place in the geographical areas provided below.

Geographical Area

The online sale of the products and services presented on the site is reserved for buyers residing in the EEC and outside the EEC and for deliveries requested only in France. Buyers residing outside Metropolitan France must take charge of the transport of the goods.
The order must therefore be placed indicating payment by check, a Proforma invoice will then be sent tax-free including adjusted shipping costs.

Orders

The minimum order amount is €150 excl. VAT.

The buyer wishing to purchase a product or a service must necessarily:

– fill out the identification form on which he will indicate all the requested details or give his customer number if he has one;

– fill out the online order form giving all references of the products or services chosen;

– validate his order after having checked it;

– make the payment under the conditions provided;

– confirm his order and payment.

In case of exceptional return of the goods, the shipping costs "Outbound" and Return are the responsibility of the customer

Confirmation of the order entails acceptance of these terms of sale, recognition of having perfect knowledge of them and waiver to avail oneself of its own conditions of purchase or other conditions.

All data provided and the recorded confirmation shall serve as proof of the transaction. The confirmation shall serve as signature and acceptance of the operations performed.

The seller will communicate by email confirmation of the recorded order.

Payment Methods

The price is due at the time of order.

Payments shall be made by card, check or accepted bills of exchange (for major retailers).

The buyer's account will only be debited upon shipment of the available products or services and only for the amount of products or services sent or downloaded.

At the request of the buyer, a paper invoice showing VAT will be sent to him.

Refunds will be established in the form of a credit to be used on the following order.

Payments via the Paypal site will be subject to a processing fee amounting to 5% of the basket amount.

Deliveries

Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area.

Risks are borne by the purchaser from the moment the products have left the premises of New Discount. In case of damage during transport, a motivated protest must be made to the carrier within a period of three days from delivery.

Orders are generally processed within 7 working days. Delivery times are given for information only; if these exceed thirty days from the order, the sales contract may be terminated and the buyer refunded.

Transport costs are calculated directly at the end of the order based on the products and quantities purchased.

Delivery is free in Metropolitan France only. Deliveries for DOM-TOM countries will be delivered to the carrier handling the transit for the client. If you wish us to handle the delivery, please contact us to review your order, weight and shipping rate.

Orders paid via the Paypal website will be shipped within a period of 8 days necessary for the verification of the transaction.

Orders paid by check will be shipped within a period of 15 days necessary for the verification of the transaction.

Liability

The seller, in the process of online sale, is only bound by an obligation of means; its liability cannot be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other unintentional problems.

Intellectual Property

All elements of the New Discount site are and remain the intellectual and exclusive property of New Discount.

No one is authorized to reproduce, exploit, rebroadcast, or use in any way whatsoever, even partially, elements of the site whether software, visual or sound.

Any simple or hypertext link is strictly prohibited without an express written agreement of the seller.

Personal Data

In accordance with the law relating to data processing, files and freedoms of January 6, 1978, information of a nominal nature relating to buyers may be subject to automated processing.

New Discount reserves the right to collect information on buyers including using cookies, and, if it wishes, to transmit to commercial partners the information collected.

Buyers may object to the disclosure of their contact details by notifying New Discount. Similarly, users have a right of access and rectification of data concerning them, in accordance with the law of January 6, 1978.

The automated processing of information, including the management of email addresses of site users has been the subject of a declaration to the CNIL under the number 1105026.

Archiving - Proof

New Discount will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.

The computerized registers of New Discount shall be considered by the parties as proof of communications, orders, payments and transactions occurring between the parties.

Dispute Resolution

These online terms of sale are subject to French law.

In case of dispute, jurisdiction is attributed to the competent courts of Paris, notwithstanding plurality of defendants or third-party proceedings.
